Latest update for 4/15

   After receiving a letter in the mail today.I was asked to babysit again so Havalah could attempt to meet with the Jag lawyer.According to the letter, Brandon's Will states that his Mother would be granted all his affects that are returning from Iraq.including the presents he bought for his family while he was deployed,His laptop which has special pictures that Havalah had sent to him under the impression only he would see them.Apparently his Mother Christine  has already begun the probate process in Washington without Notifying his next of kin that they should contact the probate lawyer and have the opportunity to contest anything.Havalah would have no way to protect herself and her children had she not received this letter.The lawyer handling Brandon's estate has yet to contact her and considering she has custody of his heir,which is his Biological son,the only male in his family to carry on his fathers name.This should have been one of the first things done or so one would think.

  We still don't know if he claimed his Mother as the sole beneficiary on his SGLI or if the change made to it was him trying to upgrade to the maximum amount.He failed to submit his SGLV 8285 and was unable to verify the appropriate premium was deducted.According to this most recent information, His SGLI will only pay out $200,000; instead of the maximum which would have been $400,000.At this point none of that money will be going to his widow or his children; but to his mother Christine.(The SGLI that I personally seen stated it would be divided up, Awarding his wife 75% and his mother 25%.His mother is claiming that she has an SGLI awarding it all to her,Now thats just not right).

Hmmmmm,Where to start?

So where do I Start?Should I start back over a year ago when they had a little bit of marital issues or should I start after he died? I guess I'll start after his death and slowly fill in the blanks of the past as I go.

 My Best friend Havalah and her family recently lost their Husband,Dad, and Friend of 6 years,in Iraq on March 21,2011.Before he died, her and her husband were in the process of fixing their marriage.They were talking about fixing his car together,going camping,fishing and lots of other things as a family when he returned.His return date was suppose to be about a month give or take after his death,Causing this to impact his family even more.

  As I mentioned they were having a few marital issues so before His deployment he changed his beneficiary of his $400,000.00 Soldier Group Life Insurance Policy to his mom.He also supposedly made a Will leaving all his worldly possessions to his mother as well.(Although this is yet to be confirmed as his Mother refuses to release a copy of it to Havalah. We have reason to believe both of these actions were taken under duress and with his Mother influencing his decisions.) His Mother even received the BAH that is Normally awarded to the spouse for 2 months after a soldiers death. Leaving his wife,2 biological children,and 2 step children virtually homeless.As of the day I write this she now has approximately 2 weeks to out of their house.While Havalah was in Washington burying her husband,A note was left on her door stating Balfour Beatty hadn't received the BAH for the month of March;Which is due at the end of each month.However I believe as long as Havalah can pay March and Aprils rent which equals about $2154.00,And can continue to pay $1077.00 each month she can stay in her house for the remainder of the lease.At which time the Army requires her to move off post.
 
   He was a resident of Georgia,And claimed Havalah and all 4 children on his income tax return for 2010. Which he filed while he was deployed.He deposited the funds into his separate savings account.According to this supposed Will his Mother would be entitled to that as well even though a large chunk of that was earned income tax credit for the children.His Mother has made no attempt to help his family what so ever.In fact the only people from his side of the family that Havalah or her children have heard from is; His Father,His Aunt,His Grandma,And only 1 of his sisters.Since the day she got the tragic news of his loss.


  Havalah has spoken with The Fort Stewart Post Commander,JAG,The VA,And has also contacted Congress for the state of Georgia.Havalah has let it be known that she is contesting Both the Will and The Insurance claims.
